1. The Agreement

These Terms of Service govern your use of hotwheeldispatcherllc.net and the dispatching services provided by Hot Wheel Dispatcher LLC ("Hot Wheel", "we", "us"). By using this site or submitting a carrier onboarding packet, you accept these terms.

⚠ A separate dispatch agreement governs the actual work. These terms cover the website and the general relationship. Once you are onboarded, the signed carrier–dispatcher agreement is the controlling document, and where the two conflict, that signed agreement wins.

2. What We Do — and Don't

We are a dispatch service

We act as your agent. We search for freight, negotiate rates with brokers and shippers on your behalf, secure rate confirmations in your name, run credit checks on brokers before you commit, and handle the related paperwork.

We are not a broker, a carrier, or a freight forwarder

  • We do not hold freight broker authority and we do not take title to freight.
  • We do not haul anything. You are the motor carrier; the operating authority, equipment, drivers and insurance are yours.
  • Rate confirmations are issued directly between you and the broker. We do not insert ourselves between you and your money.
  • We are not your employer, and you are not our employee. You operate as an independent motor carrier.
What this means for you: because the contract of carriage is between you and the broker, you carry the regulatory and liability obligations of the motor carrier — including cargo claims, safety compliance and hours of service.

3. Who Can Use This Service

To be dispatched by us you must:

  • Be at least 18 and able to enter a binding contract.
  • Hold active, valid FMCSA operating authority (MC and DOT numbers) in good standing.
  • Carry and maintain the insurance your operation requires — typically auto liability and cargo coverage at the limits brokers demand.
  • Provide accurate, current information in your carrier packet, and tell us promptly when something changes.

We may decline or discontinue service to any carrier whose authority lapses, whose insurance is cancelled, or whose safety rating makes them unbookable.

4. Fees & Payment

  • Our fee is 7% of the gross line-haul revenue of each load we book for you.
  • There is no signup fee, no monthly subscription, and no minimum load commitment.
  • We charge on loads we book. If we do not book you a load, you owe us nothing that week.
  • The fee is calculated on the gross rate shown on the rate confirmation, before your fuel, tolls and other operating costs.
  • Invoicing timing and method are set out in your signed dispatch agreement.

You remain responsible for your own operating expenses, taxes, factoring arrangements, and any fees your factoring company charges.

5. Your Responsibilities

  • Run the loads you accept. Once you accept a load and we confirm it, you are committed to it. Abandoning a confirmed load damages your reputation and ours.
  • Communicate. Tell us about breakdowns, delays, detention and appointment issues as they happen, not after the fact.
  • Keep your paperwork current — authority, insurance certificates, W-9. Expired documents stop loads.
  • Comply with the law, including FMCSA regulations, hours of service, and all applicable safety rules. These are your obligations as the motor carrier and we cannot discharge them for you.
  • Submit your delivery paperwork (BOL, POD, receipts) promptly so you get paid.

6. Our Commitments

These are the guarantees we make to every carrier we dispatch:

  • Zero forced dispatch. You have the final say on every load. We present options; you decide. We will not penalise you for turning a load down.
  • 100% direct rate confirmations. Rate cons come to you from the broker, in your name, showing the real rate. We do not skim the margin.
  • Broker credit checks at no extra cost before we put you on a load.
  • Transparent fees. 7% of gross line-haul. No hidden cuts, no surprise deductions.
  • We negotiate for the highest rate we can get, because our fee and your revenue move together.
What we cannot promise: we cannot guarantee a specific weekly revenue, a particular number of loads, or that any given lane will pay a given rate. Freight markets move, and anyone who promises you a fixed income from dispatching is not being straight with you.

7. Cancellation & Refunds

Cancelling the service

There is no long-term contract and no early-termination penalty. Either party may end the dispatch relationship on written notice, in line with the notice period in your signed dispatch agreement. Loads already booked and confirmed before that notice must still be run, and our fee on those loads is still due.

Refunds

Because our fee is charged per load after that load is booked, there is nothing paid in advance to refund. If we invoice you in error — a duplicate charge, a fee on a load we did not book, or a fee calculated on the wrong rate — tell us within 30 days and we will correct or refund it.

8. Use of This Website

You may browse this site, use its calculators, and submit our forms for genuine business purposes. You may not:

  • Scrape, harvest or bulk-download content or load data.
  • Submit false information, or impersonate another carrier or company.
  • Attempt to breach, probe or disrupt the site or its infrastructure.
  • Reproduce our content, branding or page designs as your own.

All site content, design and branding remain the property of Hot Wheel Dispatcher LLC.

9. Rate & Market Data

⚠ Read this before acting on any number you see on this site.
  • The load board, market rate map, lane averages and equipment figures shown on this site are demonstration and benchmark data, not a live feed of bookable freight. Individual listings are illustrative.
  • Our rate and profit calculators are estimating tools. Their output is an estimate, not a quote, and not a prediction of your earnings.
  • Diesel prices are sourced from the U.S. Energy Information Administration and are historical published figures, not real-time pump prices.
  • The only binding rate is the one written on a signed rate confirmation between you and the broker.

Do not make a business decision on the basis of a figure displayed on this website without confirming it against a real rate confirmation.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The website and its data are provided "as is", without warranties of any kind, express or implied.
  • We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, deadhead miles, or lost business opportunity.
  • Our total aggregate liability to you for any claim is limited to the dispatch fees you actually paid us in the three months before the claim arose.
  • We are not liable for the acts or omissions of brokers, shippers, receivers, factoring companies or other third parties, including non-payment, double-brokering, cargo claims, or detention disputes.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Hot Wheel Dispatcher LLC and its members and agents from claims, losses and reasonable legal costs arising out of your operation as a motor carrier — including cargo loss or damage, accidents, regulatory violations, lapses in insurance or authority, and information you gave us that was inaccurate.

12. Governing Law & Disputes

These terms are governed by the laws of the State in which Hot Wheel Dispatcher LLC is organised, without regard to conflict-of-laws principles.

Before starting formal proceedings, both parties agree to attempt in good faith to resolve the dispute directly. Most disagreements in this business are settled with a phone call and a corrected invoice.

13. Changes to These Terms

We may update these terms. When we do, we will change the "last updated" date at the top of this page, and material changes affecting active carriers will be sent by email. Continuing to use the service after an update means you accept the revised terms.
